What is the Family Law Settlement Service (FLSS)?

The Family Law Settlement Service (FLSS) is a mediation program, administered by the NSW Law Society’s Alternative Dispute Resolution department, which is most suitable for financial or property disputes that are at the post-conciliation conference stage.

Parenting matters are suitable for referral at any time and will be allocated to Family Dispute Resolution Practitioners (FDRPs).

The program is designed to avoid the costs, uncertainty and delays of having a dispute determined at a final hearing.

Parties can use the FLSS service even if they don't have a matter before the Courts.

Amending the Pro-Forma Mediation Consent Orders

The Pro Forma Consent Orders can be varied or amended by the parties to be tailored to suit their individual circumstances.

For example:

If the parties agree to a certain geographical location for the mediation to take place, the Pro Forma Consent Orders may be amended to reflect this.

Another example might be that the matter be referred to an agreed upon mediator from the FLSS Panel.

In circumstances where this is specified, the FLSS ask that parties also provide an alternative mediator should the preferred mediator be unavailable.

It is also acceptable for parties to arrive at an agreed upon list of mediators.

Parties may include a list of three (3) to five (5) mediators from the FLSS Panel.

FLSS request that parties refrain from listing mediators they do not want.

FLSS also request that parties keep in mind when preparing their list of mediators that parenting matters must be referred to a Family Dispute Resolution Practitioner (FDRP).

Please refer to the FLSS Panellists list here to ensure any nominated mediator is a FDRP (for parenting disputes).
